Contractor Contract Agreement This agreement includes the following associated entities and phrases as may be created from time to time and collectively referred to as AmazeApp - the "Business", "we", or "us". Business - the "AmazeApp", "Amaze", "Businesses", “Principal”, "we", "us", and "our". Executive Chef - the "Founder/Owner/Director of AmazeApp", "Justin Summersgill". Contractor - the "Chef", "Independent Casual Contractor", "you", "your", "yourself", "Staff". Chef - "Who provides Services to the Business", "Independent Casual Contractor". Customers - "Clients". The Services - the "Hospitality & Culinary Services in Schedule 1" - the "Chef's responsibility of Hospitality & Culinary Services in SCHEDULE 1" on page 5 of this agreement. You’re appointed as an Independent Casual Contractor of AmazeApp. We confirm our agreement that you have been appointed as an Independent Casual Contractor of AmazeApp on the terms and conditions outlined below.I confirm the Terms and Conditions of the appointment as follows:Purpose of this Agreement (a) The Business wishes to engage an Independent Casual Contractor to provide Hospitality and Culinary Services to AmazeApp clients. (b) You possess the necessary expertise and skills to provide exceptional Hospitality and Culinary Services. (c) The Business would like to appoint you, and you are willing to accept such an appointment as an Independent Casual Contractor for the Business on the terms and conditions set out in this agreement.Engagement The Business is engaging you to provide the Services described in Schedule 1 (Hospitality & Culinary Services - page 6.) (“ Services”) subject to the Terms and Conditions in this agreement. AmazeApp reserves the right to update these Services in Schedule 1 at any time and inform you of any new changes that may affect the Services you provide AmazeApp. You will report to and perform the Hospitality and Culinary Services at the direction of the "Executive Chef" of the "Business".DurationThis agreement will commence on upon return of digital contract and will continue until terminated by either party with the agreed notice period. Provision of Services by the ContractorServices(a) You agree to provide the Hospitality & Culinary Services to the Business in the manner set out in "Schedule 1".(b) If the Business asks in writing, you can provide services in addition to the Services. You may make an additional charge for providing such services to be negotiated and agreed upon by the Business first before providing any additional services. Must Perform Services PersonallyUnless agreed in writing by the Business, the Services must be performed by you personally.Facilities and EquipmentYou may, for the purpose of performing the Services, use the facilities of the Business, including kitchen equipment, office facilities, laptop, computer, photocopier and printer, telephone which may be provided or arranged by the Business. Your use of any of the Businesses’ property is at your own risk, except to the extent that any damage is caused by the Businesses’ act, omission or negligence. Where you provide or use your own equipment, the equipment must be suitable for the work purposes and be maintained by you in good working condition (tagged and tested) and safe to use at all times. We are not responsible for any loss or damage arising out of your use of any equipment not supplied to you by us. Supervisor and Reporting You will report to and perform the Services at the direction of your assigned supervisor, or such other person as notified by the Business.I UnderstandPosition Duties and Chef Job ResponsibilitiesYou will perform the following position duties as required: Work closely with the Executive Chef with menu development to meet the client's special requests/ requirements, dietary and allergen requests/ requirements Work closely with the Executive Chef in achieving business target goals within the specified budget Control and manage food costs within set targets of the allocated job budget To carry out all ingredients shopping, order stock, and maintain contact with relevant suppliers and the Executive Chef as required Adequate supervision of running daily kitchen operations, managing and controlling consistency in food preparation, food presentation and service delivery Must select appropriate ingredients within budget constraints, prepare ingredients, cook ingredients, and present dishes to clients within the specified timeline/ deadline Ensure you have read and understand you are trained to follow standards and compliance with national Food Safety Standards Australia and your governed State Food Act legislations to which State you are operating hospitality-related jobs/ tasks on behalf of the Business. Follow safe food handling practices and hygiene standards in compliance with national and State food safety standards legislation. Ensure you are trained to follow standards and compliance with workplace health and safety (WHS/ OHS) conditions whilst on the job working for the Business (Safe Work Australia) Lead, mentor, and manage culinary and hospitality staff/ teams as required Maintain standards for food storage, FIFO rotation, and correct food temperature control measures, temperature logbooks, transport logbooks, expected quality, and appearance Establish maintenance and cleaning schedules for equipment, storage, and work areas before, during and after food preparation and service delivery. I UnderstandChef Qualifications and SkillsYou must have the following: A highly structured and organised approach with good workflow and mise en place Good time management skills with the ability to work autonomously or in a team environment The ability to manage multiple tasks simultaneously Experience in multi-cuisine recipes and menu development A strong passion for Food, flexible with recipes and menu development A positive and energetic attitude towards clients and the Business Good personal hygiene and presentation standards Good communication and interpersonal skills The ability to lead and influence clients with a high level of expertise Experience in a high-volume environment with on-the-spot supply and demand An excellent work ethic, hard-working with a hands-on approach High level of creativity and flair with dishes High level of accountability and responsibility for the daily work you perform The drive to push yourself and continue to learn, grow and develop personally and professionally with AmazeApp Demonstrated knowledge of culinary techniques and practices Understanding of different menu and recipe development techniques Strong leadership abilities Ongoing awareness of modern culinary trends and technology related to the hospitality industry Understanding of health and sanitation laws applicable to your country and State of Business operations Safe and excellent knife-handling and cutting techniques and skills Applied wine and beverage knowledge (desired) Basic computer skills and experience with Microsoft Office (Word, Excel, and Outlook) Education Requirements: Certificate III in Commercial Cookery (minimum) SITXFSA005 - Use hygienic practices for food safety (Food Handler certificate 1) SITXFSA006 - Participate in safe food handling practices (Food Safety Supervisor certificates 1 & 2) Experience Requirements: 3-5 years experience in medium to high-volume kitchens Previous kitchen management or kitchen operations experience Experience performing private chef and catering services (desired) We can also assign you other reasonable duties for your position, training and experience.I UnderstandSCHEDULE 1 Hospitality & Culinary Services(a) The Services (Hospitality & Culinary Services) will include:(I) A variety of Culinary Services to the level of the Contractor's qualifications and training as agreed with the AmazeApp Business in writing(II) A variety of Hospitality Services to the level of the Contractor's qualifications and training as agreed with the AmazeApp Business in writing(III) A variety of Front of House Services to the level of the Contractor's qualifications and training as agreed with the AmazeApp Business in writing(IV) Comply with the "AmazeApp Business" agreed to a food shopping budget of 20% per event, no more(V) Comply with the Terms and Conditions outlined in this agreement.(b) The Services will be performed at the following location(s):Workplace LocationsYou will be required to work mobile at the following areas/ locations: - Australia-wide (Metropolitan, Suburban, Regional, and Remote locations)- Overseas when applicableWorking Facilities- Commercial Kitchens- Commercial venues- Private residencesTerms and ConditionsYour Terms and Conditions are those set out in this agreement. TravelFor all travel within a 50km radius of the Contractor's residential address, the Contractor agrees to be responsible for all travel-related expenses associated with the agreed job or task with AmazeApp.Suppose we ask you to travel outside the 50km radius of your residential address for agreed work-related activities, in that case, AmazeApp reserves the right to negotiate a fair travel compensation or allowance with the Contractor.Hours of WorkAs a casual Contractor, there is no guarantee of ongoing or regular work and your hours may vary depending on the business needs and volume of work.Rosters & Work AvailabilityAmazeApp has a private WhatsApp worker's group where jobs are posted regularly. We look at who is available for the job, where the Contractor is located vs. the job location, work performance review and customer feedback on past events/assignments, matchmaking based on the level of experience and skill-set required for the job, equality and a fair go. Hence, all our chefs get the opportunity to work and shine for AmazeApp.If we need to change your roster for obvious reasons, such as a last-minute client cancellation, we would like to change it within 24 hours notice but cannot always guarantee this. Suppose any agreed shopping has been purchased before the cancellation, in that case, AmazeApp will reimburse shopping expenses provided the Contractor can produce the receipts for the agreed ingredients for the job/ task agreed to by the Business.Suppose any agreed shopping has been purchased before the cancellation, in that case, AmazeApp will reimburse shopping expenses provided the Contractor can produce the receipts for the agreed ingredients for the job/ task. If you'd like to ask for a change to your roster, we need a minimum of two (2) weeks' notice. You will need our written agreement to change your roster or hours.Contractor Acceptance of Work & Cancellation Notice PeriodIf you accept work, a booking, or an event with AmazeApp booking, you agree to own that work/booking/event; you agree to be responsible for that work/booking/event. If you need to cancel work/booking/event you accepted with AmazeApp, you must provide a minimum two (2) weeks' notice period and provide valid reasons why you need to cancel. We may request evidence to support your claim if you cannot make the work/booking/event.If you have been booked for work/booking/event and can no longer work/booking/event for a valid reason, we require a minimum of two (2) weeks' notice period. You will need our written agreement to change your roster or hours. Suppose you do not provide the correct notice period or requested evidence for the reason for the cancellation of work/ booking/ event. In that case, you may be liable for any financial losses or damages to AmazeApp. This may also affect your Amaze Profile and Reputation and future work opportunities with AmazeApp catering and events services. We require adequate time to replace staff for events at such short notice as we have paid clients that are relying on the delivery of our services on specific dates and times.If you wish to ask for a change to your roster, then we require a minimum two (2) weeks' notice period. You will need our written agreement to change your roster or hours.Cancellation Policy for Chefs(a) If you have to cancel a reservation without providing the minimum two (2) weeks' notice period or a valid reason:(i) Your ranking on the platform may be negatively affected, meaning that you might receive fewer service requests;(ii) There will be a 30% penalty charge on your next Reservation for damages and losses;(iii) Your calendar will not be available for the Date of the cancelled Reservation; and(iv) You will be subject to suspension from AmazeApp if you cancel more than two (2) reservations in a six (6) Month period or termination from AmazeApp if you cancel more than two (3) reservations in a twelve (12) Month period without good reason and supporting evidence.(b) If your Diner cancels their Reservation:(i) Up to twenty-eight (28) days before the Reservation: you will not be entitled to compensation;(ii) Between fourteen (14) days and twenty-eight (28) days before the Reservation: depending on the diner's decision:A. The Reservation will be rescheduled within the following ninety days (90) days; orB. You will be compensated 20% of the total amount to be received; (iii) Less than fourteen (14) days before the Reservation: you will be compensated 25% of the total amount to be received.Staff BreaksWe encourage all our Contractors to take a 10-minute paid rest break within 6 hours and a 20-minute paid lunch or dinner break for every shift over 6 hours. Contractors must take a break to comply with workplace health and safety standards.Pay and AllowancesWeekday & Weekend RatesChefs will be paid an estimated minimum wage of 25% of the total sum of an event for an agreed 8-hour working shift for weekday and weekend work. Wages may vary on specific events and hours required to work as agreed by both the "Business" and the "Chef". However, chefs can expect an average hourly wage between $50 to $100 per hour, with events offering an average of $400 to $1,000 per day.Public Holiday RatesChefs will be paid an estimated minimum wage of 30% of the total sum of an event for an agreed 8-hour working shift for public holiday work Wages may vary on specific events and hours required to work as agreed by both the "Business" and the "Chef"; however, chefs can expect an average hourly wage between $80 to $120 per hour, with events offering an average between $800 to $1,200 per day.You do not have to work on a public holiday. We may ask you to work on a public holiday, but since you are a casual Contractor, you may not be able to accept our work offer. If you work on a public holiday, you are entitled to a higher agreed pay rate as set out in the pay and allowances section of the Terms and Conditions.These pay rate averages do not include superannuation; you are solely responsible for paying and contributing to your superannuation account. You will not be paid further penalty or overtime rates outside the agreed working hours and wages with AmazeApp.Payment MethodAfter you have completed a job/ task as agreed by AmazeApp and provided your end-of-job/ task report to the Executive Chef, you are then required to send an Invoice for the agreed hours you have worked. AmazeApp will pay you within seven (7) business days into your nominated bank account.Invoices, at a minimum, must include the following information: - Contractor full name- Residential address- Phone number- Email address- ABN number- Amount of agreed hours worked (time allocated per task) - Detailed description of agreed activities undertaken- (MUST provide all shopping receipts with Invoice) If this information in your Invoice is not clearly stated, then, AmazeApp may ask you to clarify the Invoice or resubmit the Invoice with shopping receipts before processing a Contractors pay. The Contractor is responsible for ensuring all information is included and correct before sending their Invoice to AmazeApp for quick payment processing of wages. Annual Pay ReviewWe will review your pay annually to determine whether you are eligible for an increase, taking into consideration the following: Your work performance The Business's financial position. Any increase in your pay is the Business's decision.AllowancesYou may be entitled to other allowances, for example, if you: Do specific tasks or have a particular skill Have to use your tools or equipment at work Work in specific conditions, environments or remote locations. CommissionIn addition to your agreed hourly wage, we will pay you a commission under the following arrangement:We will pay you a 10% commission on booking leads over $2,000 for a catering event you acquired and successfully booked with AmazeApp. You will receive your 10% commission within seven (7) business days after the client pays the total amount for the catering event.We will update this agreement if we agree to change this commission arrangement during your engagement with us. Just so you know, you will be informed of any changes to your commission arrangement.Annual Bonuses and Incentives BonusesBonuses and incentives will be routinely given based on workers' individual or group performance(s).We may pay you an annual bonus at our discretion, considering your work performance and other relevant business factors. There is no guarantee that you will get a bonus, and you will not be eligible for one after your employment with us ends.Profit Share Arrangement or Bonus Schemes You may from time to time become eligible to participate in a profit share scheme or other incentive plan approved by the Business. Any payment or other benefit to you as a result of participation in any profit sharing scheme or incentive plan will be governed entirely by the rules of such plan as they may exist from time to time. Any such payment or other benefits will not be included as part of your total remuneration package. Client TipsAll financial tips you earn on the job from Clients are yours to keep; we ask that you please declare the number of financial tips to the Executive Chef for our ongoing records.I UnderstandYour ObligationsContractor obligations:As a Contractor of our Business AmazeApp, we expect you to:Performance of Services Comply to "SCHEDULE 1" outlined on page 6 of this Contractors Contract Agreement Agree to the total food shopping budget of 20% per hospitality event; no more You must perform the Services diligently and professionally according to the standards that apply to such services. If you breach this obligation, you must resupply the Services at no cost to the Business. You must act in good faith in all dealings with the Business and must not do anything that may harm the Business’s reputation or interests. You must liaise with and report to the Executive Chef concerning all aspects of the Services. Carry out all duties to the best of your ability and not stand around when there is nothing to do Act honestly and be transparent to the Executive Chef in the best interests of the Business and our clients Be reliable and meet all job tasks requirements to deadlines as instructed by the Executive Chef Perform at the level of expectation of your agreed job position, duties and responsibilities Comply with our business policies and procedures, which we will make available to you Comply with national and State legislation Comply with any other lawful and reasonable directions we provide you. Event Shopping Budget | 20% Total Food CostContractors and Chefs agree to spend a total of 20% on shopping costs for food, produce and ingredients for each allocated hospitality event. Contractors and Chefs have an obligation and agreement to meet the standard quality of all ingredients and dishes required for AmazeApp menu items and services.Suppose Contractors and Chefs come under the 20% shopping total cost budget. In that case, they will be incentivised to keep the remaining % if below costs and the quality ingredients and dishes meet the standard quality requirement for AmazeApp menu items, services and customers’ expectations.Contractors and Chefs agree to purchase most fresh produce from the markets, butchers and craft suppliers to ensure that AmazeApp delivers a standard quality of fresh ingredients from paddock to plate to our paying customers.Contractors and Chefs are not permitted to purchase all Food, produce and ingredients from supermarkets as it can potentially decrease the standard quality, value and reputation of AmazeApp dishes and services to our paying customers. We encourage all our Contractors and Chefs to explore markets, butchers and craft suppliers to open up their creative flair with Food and presentation.AmazeApp will be monitoring all purchases made by Contractors and Chefs. Purchases of all shopping, ingredients, and the quality of ingredients and dishes presented via proof of shopping receipts, photos of products and dishes, and customer feedback on dishes and experiences.Contractors and Chefs are to send all shopping receipts and verify the quality of the products via receipts and pictures after every event is completed. All shopping receipts are to be attached with your Invoice upon sending your Invoice to AmazeApp accounts or you risk having payments delayed until AmazeApp Accounts has the required correct information.Contractors and Chefs that go over the allocated agreed total food budget of 20% shopping budget/food costs for hospitality events are in breach of this agreement. They may find they will have their wages deducted from the total purchases made without the Executive Chef’s written permission.Contractors and Chefs are permitted to purchase personal items such as; Food, produce, ingredients, beverages and equipment or other personal items for consumption and use which is not in whole or part of the agreed menu and ingredients without written permission from the Executive Chef first. Contractors and Chefs in breach of this clause may find they will have their wages deducted from any additional purchases made without permission.Please ask our Executive Chef if you are unsure about anything stated above regarding the 20% total food cost budget per event or prior to purchasing ingredients on your shopping list.I UnderstandPolicies and ProceduresYou agree to be bound by the policies, written codes of conduct, and practices or procedures of the Business as may exist and be varied from time to time. These include (but are not limited to) policies in relation to uniform, discrimination, codes of conduct, workplace, healthy and safety and gifts, inducements and bribes. You agree to read and revise the policies of the Business and their variations from time to time. AmazeApp Staff Uniform Policy CHEFS- Chefs jacket (white or black)- Black pants (not checked)- Apron (black or striped)- Black shoes (safe non-slip closed footwear)FOH STAFF- Black or White dress shirt- Black dress pants- Black apron- Bow tie or Necktie (optional , however recommended)- Black shoes (safe non-slip closed footwear)BAR STAFF- Black or White dress shirt- Black dress pants- Black dress apron- Bow tie or Necktie (optional , however recommended)- Black shoes (safe non-slip closed footwear)All uniforms and clothes must have no stains, holes, or tears and must be ironed before use to meet AmazeApp business presentation standards. Hats are not required for staff members unless working in a commercial kitchen environment; however, personal presentation with hair is a must; long hair must be tied back and look respectful at all times. We encourage all our staff to use hair products and deodorant (personal hygiene and presentation) as you will be engaging with guests and may have photos taken of you by guests and AmazeApp to be used for potential private use by guests, media and promotions from AmazeApp.If a staff member breaches this Standard Staff Uniform Policy, they will then be dealt with accordingly by the Executive Chef.Compliance with Laws(a) You must comply at your own cost and expense with all Acts, ordinances, rules, regulations, other delegated legislation, codes and the requirements of any Commonwealth, state and local government departments, bodies, and public authorities or other authority so far as these same may affect or apply to you or the Services.(b) You indemnify the Business from and against all actions, costs, charges, claims and demands in respect of any breach of this agreement.Warranties (a) You warrant that you have no authority to engage the services of any person as an employee or agent of the Business without written permission from the Executive Chef first(b) Except with the prior written approval of the Business, you will not bind the Business to any contract or create any liability against the Business in any way or for any purpose.Survival of ObligationsThe obligations will survive the ublicteon or expiry of this agreement.Relationship between PartiesThe relationship between the Business and you is that of a principal and an Independent Casual Contractor. Nothing in this agreement constitutes the partnership or employer-and-employee relationship between the Business and you.Duty of CareContractors must:Take reasonable care of your health and safety in the workplace. Take reasonable care not to adversely impact the health and safety of yourself, co-workers and customers. Cooperate with the Business to maintain health and safety in your work environments.Workers ResponsibilityWorkers must: Take reasonable care of your health and safety in the workplace environment Take reasonable care not to adversely impact the health and safety of co-workers and customers Cooperate with your employer to maintain health and safety in your workplace environment Report any incidents, risks or hazards to your supervisor “Executive Chef” Wear and maintain in good order any personal protective equipment connected with your daily work activities. Hazard AwarenessCommon hazards that workers in this industry are exposed to include: Exposure to heat, electrical devices and sharp objects Excessive loud noises Demanding and aggressive customers Long hours standing Unorthodox or impromptu workspaces. Safe Work Australia – HazardsI UnderstandContractor Medical and Disability Conditions Disclosure & LiabilityAll Contractors and Chefs have the responsibility and agree to disclose all past, present, and ongoing medical and disability conditions to AmazeApp, the Business, and all medical and disability conditions that may affect, present injury, or have the potential to affect and potential of injury in your position whilst undertaking, duties, jobs, tasks, and activities in any physical or non-physical capacity, and or, be a liability to your health and safety at work and in the workplace environment, and a liability to the Amaze App, the Business. Failing to disclose all past, present and ongoing medical and disability conditions to AmazeApp, the Business, you may not be covered by insurance. AmazeApp, the Business, may refuse to pay for medical expenses or sort workers’ compensation. We may also ask you to present evidence when claiming injury. All personal information provided to AmazeApp is protected by our Privacy Policy and legislation, The Privacy Act 1988 (Privacy Act).I UnderstandInsuranceAmazeApp holds a valid Public Liability Insurance Currency of $20 million dollars for Public and Products Liability.Limit of Liability – Public & Products Liability $20,000,000You must take out all insurances that are required to be effected by law, including but not limited to your own public liability insurance policy and any other insurances that may be listed in Schedule 1. The insurances must be taken out for the minimum amount set out in schedule 1. Each policy must be maintained during the term if this agreement. If requested by the Business, you must provide the Business with a certificate of currency.I UnderstandPrivacy and ConfidentialityYou agree not to use or disclose confidential information about the AmazeApp business, our workers, and our customers. This includes while employed as a Contractor by us and after your engagement ends. Confidential information – including information marked as confidential, information related to the Business, financial information, trade secrets, pricing structures, documents received or that you create while employed with us and all sensitive and private information of our workers, clients and suppliers – is our property. There are exceptions if: We have given you our written consent first from the Executive Chef You are using the information appropriately to do your work for us as requested The information is already publicly available (public domain) The information is required by law or requested by the law. Privacy You agree to comply with all privacy obligations under national and State law or regulation including the Privacy Act 1988.Confidentiality ObligationsUnless you have previous written consent from the Business, you must:(i) Only use the Confidential Information to perform the Services outlined in this agreement(ii) Not use or attempt to use any Confidential Information in any manner which may prejudice the confidentiality of the Confidential Information or injure or cause loss to the Business(b) You must always store all Confidential Information safely and securely(c) You must notify the Business in writing at once of any actual, threatened or suspected unauthorised disclosure of any Confidential Information(d) Your obligations about the Confidential Information will continue for so long as this information is maintained on a confidential basis:(i) By the Business, in the case of Confidential Information about the Business's Business, or(ii) By the Business's client, in the case of Confidential Information about the Business of a Business's client.Indemnity and Breach (a) You indemnify the Business against all liabilities, costs and expenses which the Business may incur as a result of any breach of your confidentiality obligations by you. (b) You acknowledge that damages may be an inadequate remedy for breach of your confidentiality obligations and that the Business may obtain injunctive relief against you for any breach of your confidentiality obligations.I UnderstandFurther ClausesSurvivals of ObligationsThe obligations you accept under this clause survive the termination or expiry of this agreement.Conflict of InterestWhile employed with us, you must get our written agreement before working for existing customers and workers in our database or doing any such activities that may conflict with the interests of our Business and operations. You must not do Business with our existing customers in our database for five (5) years after leaving AmazeApp as a Contractor.Intellectual PropertyYou acknowledge that the Business owns all Intellectual Property created by you in connection with the Services, that now exists or that later comes into existence. You assign all your rights in such Intellectual Property to the Business. You will do all things and execute all documents necessary to secure the Businesses’ ownership of the Intellectual Property. You must disclose to the Business promptly and fully all discoveries, improvements and inventions made or conceived by you (either solely or jointly with others) in the course of performing the Services which are similar to the actual or anticipated business, work or investigations of the Business or which result from or are suggested by any work performed for the Business (“Inventions”). Such Inventions, whether or not they contain Intellectual Property rights capable of protection, will be and remain the sole and exclusive property of the Business or its nominees. For the purposes of this clause, Intellectual Property includes but is not limited to: Menus Signature recipes Designs Logos Business and domain names Copyright Trademarks and patents Processes and know how You must not use or reproduce any intellectual property owned by AmazeApp without our written consent first. This includes after your employment ends with us. You agree to indemnify the Business fully against all liabilities, costs and expenses which the Business may incur as a result of any breach of your intellectual property obligations by you. Your intellectual property obligations under this clause survive termination or expiry of this agreement.Consultation for Workplace ChangesIf we intend to make significant changes in the workplace, we will consult with you following our workplace policies and procedures. This includes major changes to: Our business operations, structure or technology that are likely to significantly affect you and the work/ tasks you perform with AmazeApp Your regular roster or ordinary work hours – if you work normal hours. DisputesIf you have any concerns about your engagement, talk to us first so we can try solve the issues together. We will follow a dispute resolution term that sets out this process. If the dispute remains unresolved, you or we may refer it to the Fair Work Commission or Legal Advisor. If this happens, you can be represented by another person or organisation.While the dispute is being resolved, we may ask you to stand down from work activities/ duties until the dispute has been resolved, or we may ask you to continue to work as usual.I UnderstandEnding EmploymentTermination for Breach (a) If a party breaches any term of this agreement, the other party may give notice requiring that party to rectify the breach. Suppose the notified party fails to rectify the breach in a timely matter to the notifying party's satisfaction within seven (7) business days of the notice. In that case, the notifying party may terminate this agreement by notice in writing(b) The Business may terminate this agreement at any time without notice if you engage in a serious or material breach of this agreement.(c) The Business may terminate this agreement at any time by notice in writing to you if you:(i) Are guilty of any dishonesty, serious misconduct or serious neglect of duty in connection with the provision of the Services and Hospitality & Culinary Services in Schedule 1; or (ii) Engage in any act or omission that, in the reasonable opinion of the Business, has or will likely have the effect of causing serious or material damage to the Businesses reputation or finances.Principal NoticeAs a casual Contractor, if: We can end your arrangement with 24 hours’ notice period if there is not enough work available, or no work at all We can terminate you effective immediately for grounds of serious misconduct We decided to terminate your arrangement based on your performance and customer reviews We decided to terminate your arrangement based on an unresolved customer complaint that has Lead to business loss or damages. If your arrangement ends with AmazeApp, you will be paid out any owing amount of wages within seven (7) business days.Suppose there is any severe misconduct or business loss or damages. In that case, AmazeApp reserves the right to withhold an outstanding owing amount of wages until the claim/ case has been investigated correctly and closed. In some cases, the Contractor may be responsible and liable for financial losses and damages to the Business. Contractor NoticeAs a casual Contractor , if: If you resign, you have to provide AmazeApp with a respective two (2) weeks' notice period. If your arrangement ends with AmazeApp, you will be paid out any owing amount of wages within seven (7) business days. Suppose there is any serious misconduct or business loss or damages, in that case, AmazeApp reserves the right to withhold the outstanding owing amount of wages until the claim/ case has been investigated correctly, resolved and closed case. In some cases, the Contractor may be responsible and liable for financial losses and damages to the Business.I UnderstandMisconductWe may terminate your engagement without notice or payment instead of notice if you engage in serious misconduct.Serious Misconduct is when a Contractor: Causes serious and imminent risk to the health and safety of another person or the reputation, viability or profits of their employer's Business, or Wilfully or deliberately behaves in a way inconsistent with continuing their employment. Examples of Serious Misconduct include: Theft Fraud Violence/Assault Bullying and harassment Sexual harassment or sexual assault Serious breaches of food health and safety requirements Serious violations of workplace health and safety (WHS) requirements Under the influence - being drunk or affected by other drugs in the workplace environment Refusing to carry out agreed work duties or Services and poor job performance. I UnderstandFurther ClausesPhotos, Videos & Recordings Release Clause By reading, understanding and signing this agreement, you hereby automatically grant permission for AmazeApp business to use photographs, videos and recordings of you at work, your work activities and your Amazing food creations taken on any date at any work location to be used in any/all publications, press releases, news releases, online, websites, social media, and for promotional purposes and in all other communications or correspondence related to the mission and Business of AmazeApp and its business operations. Photos and Videos may only be used for the sole purposes of AmazeApp business-related activities and promotions.If photos, videos or recordings may pose a public danger to you, your family or other persons, please contact the Executive Chef to discuss what action can be taken to remove the material.
